Kakes the Great Popcorn Co. Fundraising Program - Terms of Service

Welcome to the Kakes the Great Popcorn Co. Fundraising Program! By participating in this program, you agree to abide by the following terms and conditions. These terms outline our partnership, responsibilities, and processes to ensure a smooth and successful fundraising experience.
1. Program Overview

The Kakes the Great Fundraising Program allows organizations to sell gourmet kettle corn to raise funds.

Participating organizations will receive 50% of all sales revenue (minus a 3.3% processing fee).

Orders are delivered directly to the organization for distribution to supporters.
2. Eligibility & Participation
-
This program is open to schools, sports teams, PTO/PTA groups, nonprofits, and community organizations.

A minimum order of 50 bags is required to participate.

Organizations must submit an online application and agree to these Terms of Service before fundraising materials are provided.
3. Fundraiser Timeline & Order Process

The fundraiser runs for up to two weeks, unless otherwise agreed in writing.

Organizations must collect and submit all orders and payments by the specified deadline.

Once orders are submitted, an invoice will be generated and must be paid in full before order processing begins.
4. Payment Terms

Kakes the Great Popcorn Co. only accepts payment via organization-issued checks.

Checks must be made payable to: Kakes the Great Popcorn Co.

No personal checks, cash, or online payments are accepted unless otherwise agreed upon in writing.

Full payment is due upon receipt of the invoice to avoid delays in processing orders.
5. Profit & Fees

Organizations keep 50% of all sales revenue, minus a 3.3% processing fee for payment processing and administrative costs.

Profit is based on the total order amount after any deductions.
6. Order Fulfillment & Delivery

Orders will be processed and delivered within two weeks after full payment is received.

All products are shipped directly to the organization for distribution to supporters.

The organization is responsible for ensuring accurate and timely distribution to supporters.
7. Refunds & Exchanges

All sales are final. Refunds or exchanges are only available for defective or damaged products.

Any product concerns must be reported to kakesthegreat@yahoo.com within 3 days of delivery.
8. Organization Responsibilities

Ensure accurate order tracking and payment collection from supporters.

Distribute products to supporters promptly upon delivery.

Use marketing materials provided by Kakes the Great Popcorn Co. to promote the fundraiser.
9. Liability Disclaimer

Kakes the Great Popcorn Co. is not responsible for lost, stolen, or mishandled payments collected by the organization.

The organization is responsible for ensuring accurate financial reporting and timely payment submission.

Kakes the Great Popcorn Co. is a for-profit business, not a charitable organization.
10. Scheduling & Availability

Certain limitations apply to fundraiser start dates to ensure we can accommodate all participants.

If a requested start date conflicts with another fundraiser, we will work with the organization to select an alternative date.
11. Agreement & Acceptance
By participating in the Kakes the Great Popcorn Co. Fundraising Program, the organization agrees to the terms outlined above.
